FALSE PERSONATION
Anyone displaying Fraternal Order of Police active member medallions or active member stickers who do not have a Fraternal Order of Police valid membership card, can be charged with the following State Statute:
720 ILCS 5/17-2 Impersonating member of police, fraternal or veterans' orginization or representative of charitable organization.
(a) A person commits a false personation when he falsely represents himself to be a member of any police, fraternal or veterans' organization, including the Illinois Police Association, or a representative of any charitable organization, or when any persn exhibits or uses in any manner any decal, badge or insignia of any police organization when not authorized to do so by such police organization.
Note: As a member of the FOP you may display medallions or stickers on your vehicle, but what if a family member drives your car? We suggest that you make a photocopy of your FOP card and leave the copy in your car. This may help if challenged by the police.
DECERTIFICATION OF LAW ENFORCEMENT OFFICERS
On August 13, 1999 Illinois Governor Ryan signed a bill that provides for the decertification of law enforcement officers convicted of Felony offenses and certain misdemeanors.
The law provides that full-time and part-time police officer in the State must report to the Training and Standards Board within 30 days, and the officer's sheriff or chief executive officer, of his or her arrest or conviction for any of the following offenses:
ILCS 720 5/11-6 Indecent solicitation of a child, 5/11-9.1 Sexual Exploitation of a child, 5/11-14 Prostitution, 5/11-17 Keeping Place of Prostitution, 5/11-19 Pimping, 5/12-2 Aggravated Assault, 5/12-15 Criminal Sexual Abuse, 5/16-1 Theft, 5/17-1 Deceptive practices, 5/17-2 False Personation, 5/28-3 Keeping a Gambling Place, 5/29-1 Offering a Bribe, 5/31-1 Resisting or Obstrucing a Police Officer, 5/31-6 Escape, 5/31-7 Aiding Escape, 5/32-4a Harassment of Jurors or Families of Jurors, 5/32-7 Simulating Legal Process, 550/5 Manufacture or Delivery of Cannabis, and 550/5.2 Delivery of Cannabis on School Grounds.
Any police officer convicted of these offenses, immediately becomes decertified as a matter of law. Failure of a convicted officer to report a conviction or continuing to practice law enforcement following a conviction is a class 4 Felony. This means that you must report yourself to the State Training Board, and surrender your Law Enforcement Certification. |
